I'll try to keep this short!
I am remorgageing.
On 03/06/05 I received a letter from the solicitor working on behalf of A&L my new lender to say there was a shortfall in the redemption figure of £3,637.37.This I paid immediately by debit over the telephone.(this figure included a morgage payment of £400.05 which had not yet cleared).
The morgage was to complete on the 16 June 2005.
On 15/06/05 I received a further letter stating there was a £3,390.97 shortfall and that the morgage would complete on 30 June 2005.
I immediately contacted them and was told that this was because The Abbey(my previous lenders)redemption statement was only valid for 7 days. I pointed out that I had paid the amount outstanding well within the 7 days. She acknowledged that their was some fault with them and did not understand why it had not gone through and why I had been sent out a further short fall letter.
She said that she would rush it through to complete on the 20June 2005.
I have just telephoned them to confim that this has happened to be told yes.
However I understood that it was going through at the first redemption figure but it is going through at the second.
I was given the excuse about 5 days for funds to clear before they request money from A&L etc.
I cant help feel miffed that these people have held on to my £3,637.37 for 17 days without doing anything about it. In the meantime I am paying interest to the Abbey on my morgage.
I feel that they have cost me money..maybe not much, but have they?
She did say that they had £350 over paid which she COULD arrange to have forwarded to myself. Should this not have been done?
If they do this with all the customers they will be making a handsome interest!

Solicitors normally hold clients money in a client account - or should do -therefore any interest and surplus can be refunded back to upon completion.
When you engaged to the solicitors it is likely they gave you a letter with their terms of business and what to do in the event of a complaint.
If you feel they have acted wrongly you shoukd first try and speak to your solicitor - it may be all that is needed to rectify matters to your satisfaction.
If this gets you nowhere then invoke their complaints procedure. They will have one.
