Help with Resolvecall! Debt over 6 years old

Hello all,

Thanks for taking the time to read…..

I have received a letter today from Link Financial stating a company called Resolvecall with conduct a visit to my house.

The debt relates to a Barclays credit card.  The card was opened in 2008 and I would say I probably defaulted between 2010-2012.  Since I defaulted I have never had contact with either Barclaycard nor any of the debt agencies.

I have logged on to my Experian report and I can see it shows 2 defaults - the original Barclaycard and then Link Financial - these are the same debt.  The Barclaycard one says date of default 27/08/2020 and the balance shows £0.
The Link financial has the same default date but the balance as £763.

I understand Resolvecall can’t enforce etc But the thought of them coming to my house is stressing me out, especially as I have children at home.

Should I send a letter or do you think this will just kickstart things?

I really appreciate your time and help with this.

xo

Its quite likely the only evidence of their visit will be a card in the letterbox, they can be quite shy these Resolvecall folk.
Honestly, I can`t stress enough just how unimportant this company is, if they knock on the door, you say "no thanks" bye, and go on with your day without giving them a second thought, they are irrelevant in this matter.

What is relevant though is the discrepancy in the default dates, you say 2012, they say 2020, that`s an 8 year difference, who is right here?

Its not two defaults, its one default, with an entry from the original creditor, and one from the new owner, all nice and correctly done.

However, don`t be doing anything until you are certain on your dates, as by their reckoning, its not statute barred until August this year.

It sounds like they have fiddled with the dates, which is naughty.

You can either get involved with a long argument, or just with till September and send them a statute barred letter. I would do the latter

Between now and then you will probably get several offers to settle. If you do get a Letter before Claim, though, you do need to revert back to argument mode. Post if it happens
  • Thank you both…..

I absolutely know it’s been longer than 6 years and a lot longer than 2020, which is definitely very naughty.

I don’t really want to rock the boat either now because of this date discrepancy so I think I will hold out.

What does Letter before Claim mean?

I am based in Northern Ireland too in case that matters / or changes things

I believe in Northern Ireland legal action to obtain a CCJ is referred too as a "civil bill".

Basically if the lender wants to take you to court you should not ignore the letters they send you, in your case you may want to defend any such claim, as being statute barred, but there would be the issue of the incorrect default dates.

This isn`t to say that will happen, but to be prepared in case it does.
