Relationship break while in an iva and have a morgage together

Are you both actually selling the house or is your ex just trying yo get you off the deeds?
Why not
Get out of the IVA
Then sort out the house
Then clear the debts?

I am a bit surprised that your IP has allowed this situation to run for over 3 years.
I have heard that this is surprisingly common. IVA firms seem pretty sloppy about it, because there is little they can do if the partner refuses to sign the RX1 form. In most cases the IVA firm gets a decent result by just letting the IVA proceed normally.
In this case, the fact there isnt a restriction doesnt help that much. If the house is sold and the debtor refuses to pay their share of the equity into the IVA, then this is one of the rare occasions where bankruptcy may be considered.2 -
Yes she thought she could release have of the equity to me. Then iam off the morgage. To just give up on the morgage. Iam 3.5 years into it.0

She is going to need to see a solicitor
An option would be she could wait until your IVA completes

But the iva might not be feasible now . As I'm on universal credit with no bills. As I'm back with my mam0

It would be helpful, and much more beneficial to you, if you could characterise your circumstances in a few short sentences, giving us the full picture, rather than drip feeding information in bits and bobs.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
