Rest time between shifts

Is it legal for a triple split shift on a rolling rota to finish at 10pm and begin again at 7am the following day? 
One week Mon Tue Fri Sat Sun is worked, one week Wed Thur is worked.

    My understanding of the Work Time Directive was that you are allowed 11 hours rest between the end of one shift and the start of the next in general, however there are exemptions to this if you work in the Emergency Services for example. An individual can also choose to opt out of this arrangement.

    So there's no clear answer to your question with providing some more information specific to your circumstances.

    yes definitely 11 hours between shifts.  So presumably that means between Monday and Tuesday and then again between Friday and Saturday and then before working Sunday.  With some exceptions apparently.  So as already said - it depends.

  • My work consists of 2 split shifts, roughly 7am - 10.30am and then 2pm - 5.30pm
    We do get a small shift allowance.

    As above it’s about compensatory rest depending on the industry that you’re working in. Care homes,  restaurants et cetera also work under the different rules with regards to shifts and where the compensatory time is over a long time period. 
    All shall be well, and all shall be well, and all manner of things shall be well.

    you cannot opt out of daily rest , an EWTD  opt out is ONLY  for thre  48  hour  averaged over 17 weeks   working week you still MUST have 11 hours between shifts unless covered by an Employer/ type of  work  exemption and MUST have 35 ( 60 if under 18)  continous hours of rest per  week

  • Thanks for your replies. The work is reablement/care work, working for a council. I was surprised the rota did not allow 11 hours between shifts, as actually by the time travelling between sites is considered, the break could be less than 8 hours.

    The break from work is still the same no matter whether you live down the street or a bus journey away.

    The break starts when you stop work and starts when you commence work.

    Travelling to and from work is in your own time, not part of your break from work.

    break is clock out  to clock in regarldess of the distance you choose to commute 
  • Time to talk to your manager as it does appear your employer is breaking the law.
