The creditor has produced the CCA and there is no chance of this debt being statute barred, so what defence are you suggesting might work?0 -
a CCA on its own is not enough for one. Proof of default etc... among other things, what makes you think it is worth the cost to take him to court in the first place?
I notice you ignored my main point, you should not be on here telling people to pay "reasonable" amounts back to parasite DCAs..0 -
And you should not be encouraging people to think it is easy to win court cases when there is no obvious defence. Most people would prefer to avoid court.
Read some of my other comments, I don't think you will think they come from someone who works for a DCA.1 -
where in my statements did I say it was easy, you easily assumed Court = CCJ though.
I ask again, where is the evidence for your statements of repayments0 -
I agree, make an excuse (CT Arrears?) and reduce payment to £1 per month if they won't agree a sensible F&F. OP, pay them down to £1 per month and I predict they wont even set foot in a court room, you have probably already paid their costs for this debt by now even at £5 per month
