Technically they are right, the debt still exists and you can still pay it but they can't take any legal action if you don't. That's a pretty huge but, but they always try and downplay it to try and get money out of people who don't understand the legalities. They often come out with phrases like "valid and collectable" to try and brush over the unenforceable bit.

PRA were the same with me, they sent me letters with discount offer in big letters and then hidden away in tiny letters at the bottom of the contact us section it said it was unenforceable. They also phoned me every two days and emailed me once a week for about 18 months even though they'd said it was unenforceable. They seem to have given up now though.

Are you paying these other debts? Because if you are, this is a good time to ask for the CCA. It is possible that the right to ask for this may be removed in the next few years. The sooner you can stop paying these if the CCA cannot be produced, the better.

I can't see how to reply any more without a whole quote, sorry! I pre-empted phone calls back in the day by telling them to remove my number from their records, and it 99% worked. Phoning repeatedly is harassment AFAIC.

This is a really interesting point. So debt collection companies are going to try and get the courts to stop the right to ask for the CCA? Presumably there will be pushback from consumer groups. I just googled this and sure enough, discussions are ongoing. Thanks very much for this info!

It didn't bother me and I thought it was quite amusing to see how desperate they were, so I just let them waste their time. I blocked their number so I just got a load of voicemails with a Scottish woman saying please call us back.
