    Hi Rhibi, thanks for your comment. How does this work, do they say out loud who they are before been connected? I have an Android phone so will look into if they have a similar feature. Thanks!

    Hi sourcrates, thanks for your reply. I have looked on their website but cannot find any templates on there. Also, it is a bit difficult to search as I don't really know what to search for. Any chance of some help?

    It would also be great to get some template letters for contacting the banks to ask for original paperwork/agreements as well as any info on how to question if they were involved in irresponsible lending. I definitely should not have been given access to more credit, when it was obvious I was strugglign to pay more than minimum payments. However, how do we prove historical irresponsible lending (other than going through credit card statements/credit reports at the time (if possible to search historical credit reports)?

    Would it be possible to have the appropriate template letters added to this forums resources somewhere, so they are easy to find for people in debt?

    Any help greatly appreciated as always. Thanks

    Letter to send to creditors asking for all contact to be in writing only.

    Dear lender (insert name of company)

    (add address/date etc)

    Account/reference number xxxxxxxxxx

    Under the GDPR (General Data Protection Regulations, I am free to choose how you are to contact me.

    With that in mind, in future I request that all contact between us must be in writing only.

    Please update your systems to reflect this change with immediate effect.

    it doesn’t say anything out loud, it comes up on my phone as a message and I can choose to answer or not. My phone doesn’t even ring so often I’ve not even realised that someone has tried to phone me until later.

    Hi sourcrates, With regards to the CCA request template letter, am I right to assume that I would pay the £1 fee by cheque? Nowadays, it must cost a pound or more to actually bank a cheque so I wanted to make sure this was ok. Thanks!

    Yes a cheque is fine, this was brought into law in 1974, so quite a while ago, some companies cash them, some don`t, but to comply with legislation, its best to include it.

    So…I have received a bunch of Default Notices this week - served under Section 87(1) of the Consumer Credit Act 1974.

    I have received Default Notices from these below Credit Card Companies, all asking for a payment to be made that covers the recent payments missed. If I don't pay the various amounts by the end of May, then the whole cards Balance will become due and these accounts will all Default. Scary stuff that I knew was coming but has still got me very anxious anyway and questioning if this is the right thing to do…

    • Nationwide CC
    • Barclaycard CC
    • Barclaycard Commercial CC (I know you don't deal with business cards on the forum, but others on here have business card debt so this may be helpful for those reading my posts). They have also issued a Default letter, served under Section 87(1) of the Consumer Credit Act 1974.

    Does this prove that they operate under the Consumer Credit Act 1974? I recall their T&C's stated this, but wondered if this would be another indiscation that this was the case?

    • Barclays Bounce Back Loan. They have also issued a Default letter, served under Section 87(1) of the Consumer Credit Act 1974. They are saying that if I don't pay what I owe by the end of May, then I will have to pay back the whole balance as well.
    • Halifax Clarity CC. They have closed the account and are demanding the balance be paid in full. No Dafault notice yet though.
    • Lloyds CC. They are trying to get me to setup an instalment plan, so seem to be behind the others. Is there anyway to speed the Default process up - if I choose to go ahead with this plan?

    It would be great to get some reassurance form the forum again, that this is the best path to go down. I know we have discussed this previously in detail, but I am now on the precipice and in a few weeks I will not be able to return. Right now I have only Defaulted on one MBNA CC. They gave me a year to sort things out so have not pursued the debt, due to mental health concerns. My financial position has improved slightly in the sense that I no longer have my rental Studio and associated expenses comong out of my accoutn each month. However, I am not making any money and are currently unable to work. I am hoping I will be able to start looking for work again at the end of the month.
