Ninth Anniversary Combo Breaker

M & S delivered an empty hamper for my birthday.  My son says he filled it with gifts and food chosen from their store.  He wouldn't send me an empty hamper!  Very odd. M & S customer service are unhelpful and not going to do anything about it.  I have an empty flimsy hamper full of shredded paper?!  How weird.  M & S lost my vote now.

    Sorry, I'm a bit lost on blaming M&S here.

    You say M&S delivered it, which implies the hamper was organised and shipped by M&S (as opposed to your son buying the stuff from M&S and shipping it himself with Royal Mail, or Evri or someone). M&S do do this and obviously sell premade hampers (https://www.marksandspencer.com/l/christmas/christmas-gifts/christmas-hampers?) but from your description "he filled it with gifts and food" it sounds like he made the hamper himself by buying an empty hamper basket and various food and gifts, and then wrapped it and organised the shipment?
     
    If that's the case, I'm a bit lost on why you blame M&S?

    Presumably he received the items in the store when he handed over his cash. Exactly what did M&S do wrong?
    Surely you should be pointing the finger at the courier he organised?

    Or could it be that your son made a mistake, ordering: https://www.marksandspencer.com/the-small-make-your-own-hamper/p/hpp60788507 to be delivered to your house, assuming it would come with things inside it?

    I suspect there's more to this story.

    Your son bought and paid for the hamper so he is M&S's customer and he is the one with consumer rights. He will have a receipt showing what he paid for. He will need to complain to M&S if what was delivered was different to what he purchased.

     M&S dont sell hampers you can pick and choose your own items. 
     They have hampers already made up or you can buy an empty hamper of different sizes starting at about £25. These are for you to fill with what you want and not necessarily m&s stuff

    It sounds like OP's son bought the empty basket, and maybe the foods and gifts, from M&S and then wrapped and shipped it themselves.

    Presumably they walked out the store with the goods they paid for, so the goods have seemingly gone missing during transit.

    OP's son should be directing their focus on the courier that it seems may have had an early Christmas treat at the OP's expense.

    I'm not clear on what M&S is supposed to have done wrong.

    My BS-ometer is going into overdrive.

    Your son bought an empty hamper from M&S, put some food items into it himself and sent it to you. The food items went missing from the hamper and it arrived empty to you.

    And somehow you've concluded that all this is M&S's fault? 🤷

    This story has more holes than Swiss cheese. I doubt we'll ever hear from the OP again.
