Affordability complaints question

I sent an affordability complaint to Novuna finance using the debt camel letter template.  I’ve received a reply from them requesting evidence such as 3 months bank statements from the account I was paying the loan from, and also 3 months of statements from any account that I regularly paid direct debits from.

i just wanted to check if this is normal procedure before I send the statements off.  The summary On my statements is a bit misleading as the go month to month and my pay date is in the middle of the month so the start and end of each statement is a bit misleading.

    Some lenders ask for this. Because they are getting 3 months, they should be able to see what is going on even though you arent neatly paid at the start of the month.

    If you want them to consider an affordability complaint then you will need to provide them with the information to do so.  They are not going to decide in your favour just on your say so.

    I’ve had. Reply from Novuna after sending them statements and they have rejected my complaint.  So I guess now it’s onto the FOS.  The email states that they completed affordability checks and they have worked out that I had over £900 surplus money each month.  I don’t know how they’ve come to that figure as if I’d had that much surplus amount then I wouldn’t have needed the loan in the first place.

    i did mention financial abuse in the original email to Novuna but that hasn’t been mentioned in the reply.  I understand that as there was on court case for financial abuse, but there was for physical abuse, it is impossible for me to prove.
  • Yep onto the FOS next. It's quite easy if you've not done it yet. I'd make a point in your complaint of saying what they've stated in their defence is incorrect regarding £900 surplus, as evidenced by the bank statements attached etc. which you should send. 

    I've had one creditor of mine make an offer to refund charges and interest to the ombudsman today after I raised a complaint to the FOS, before the ombudsman has even stated the investigation. It appears from my experience so far and others advice they just reject as a matter of course most of the time on the probability that most people probably leave it at that. 

    Well done so far, I think it's great how well you're doing in your situation, keep up the momentum and pus on to the FOS!

    Yes, pass to the FOS next, it's very easy and you can do it all online. Rejections seem to be the standard response, nearly all of my complaints were rejected by the lender but I had some very good results when I passed them to the FOS. The only lender that upheld my complaint was a payday lender who offered me £25 so I just took that as it was only a £100 loan anyway.

    Thank you, I’ve completed the form, I’ve included the reply from Novuna, bank statements, the debt and mental health form and also the police charge notice.

    just a waiting game now.
