Link Financial - Father Deceased

Where do I stand with Link Financial if my father has just recently passed away and they are chasing a debt for £355.99. Do I call them and say he’s passed away or what?

    Is there an estate?
  • It depends, debts don’t die with the debtor. If the estate has the assets to pay them. There is a strict order in which estate assets are distributed.

    1. Secured debt.
    2. Funeral costs
    3. Unsecured debt
    4. IHT
    5. Beneficiaries. 

    If his estate is insolvent with no assets to pay the debt then you write to them informing them of the death (including a copy of the death certificate), tell them that the estate is insolvent and that no one is administering the estate.

    Is the estate insolvent? If not are you having to apply for probate?

    You just pass the letters on to whoever is administering the estate. They, or you if you are administering it, would contact link and tell them that the person has died and that they/you will contact them again when they/you know how much, if anything, the estate will be able to pay them.

    Who is the executor of your late fathers estate?

    They must deal with the matter, if there is sufficient money/assets to pay the debt after the important stuff has been paid, then the executer should write and tell them he is deceased, they will likely need to enclose a copy of the death certificate as well.

    If his assets will not stretch to paying this, the executer should tell them so, and the debt will be written off as unrecoverable.
