APOCA Manchester Express Pick Up PCN

Hello, I have received a PCN following using Express pick up for the alleged contravention "Use of pick up/Drop off zone without making valid payment".  It concerns T2 barrierless zone and the parking charge states notice is given to the registered keeper, and that it was private land.

My question is should I use the registered keeper response from the newbie thread which I've adapted below (is this ok for the pick up area/non-payment too?) or appeal based on what actually happened, which I think was also unfair, predatory and gave me no way to pay?

What happened: Looked up before leaving and found their site, which lists out parking charges for 15 mins, 30 mins etc.  Car parked, picked up family and left within 25 minutes (25 mins 16 seconds according to PCN).  When we returned home, logged on to pay the parking online, but was unable to pay and was met with:

"Our records show that this vehicle stayed over 20 mins at the drop off zone at Manchester Airport and therefore a parking charge for this vehicle will be sent and the registered vehicle owner will be liable to pay this charge.  Please follow the instructions on the parking charge to ensure payment is made"

The car was definitely in Express Pickup and followed all the signs - the PCN picture shows only my car and no signage (and is in the dark and cannot see the driver)

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

Due to this being airport land you will be well aware there is no keeper liability due to the byelaws in force and the fact this is not relevant land.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.


Please could you advise which is the best approach?

    Best approach is a keeper appeal based on it being airport land, no Pofa2012 schedule 4, no keeper liability 

    So same advice as in dozens if other Manchester Airport threads on here over the last 6 months or more

    Have a look at the standard airport template in them, and in the Heathrow Gatwick Manchester airport group thread 

    No blabbing about who was driving or about what happened,  don't overthink this 

    We are not interested in the backstory, it's not relevant to a Pofa2012 no keeper liability at an airport
