What would I be due paywise if I resign?

Current situation - on long term sick and only being paid SSP now. Get paid around the 23-25th of the month.

Due to long term I have 15.5 days of leave unused plus 25+26th December already booked off. 

So if I resigned on Monday what would I likely be paid?

Assuming I'd be paid -

4 weeks @ £118 for November 
But would I also be entitled to another two weeks of SSP to take me up to the one month notice?

What would happen with regards to the holiday? What I get 15.5 days @ actual salary in lieu of leave?

Finally as I wouldn't be there for Christmas, would the two days be reclaimed too? I'm not trying to be greedy, just trying to find what correct.

    What's your notice period?  Is the 15.5 days for the whole year or just up to when you might end your employment?

    So massive assumption.....if you have to give 1 month's notice that would take you up to 14/12.  You would then be entitled to holidays accumulated to that date.  That may mean that the statutory days over Christmas wouldn't get paid depending on how your employer calculates holidays.

  • I think I’ve understood your question, the leave would be part of your notice as if you were working unfortunately. Unless you could come to an understanding with them.

    Ah I see. OK if that's the case as I work part time then if fact it would cover the whole notice period! Would they actually give me that? Also then assume this would have to be paid at normal salary rather than SSP?

    It shouldn’t be SSP. I don’t know about the rules on holiday and sickness. Sometimes they say you should have been taking it as you go along.

    Is there a reason to give notice? Even if you're sure you won't be going back, there can be advantages in allowing them to dismiss you. Not least, you'll carry on accruing paid leave, which they'll have to pay you for.

    I don't think it's fair to have them keep my job open anymore.

    The difference is I've now had an OH assessment and have been told I am not well enough to.work currently. So that new job isn't happening anymore. Hence me posting this post instead.

    I certainly don’t think you should just resign. That could mean you lose out financially. What is the HR process? Are the company exploring suitable, alternative redeployment options? Is ill-health retirement an option? You aren’t assessed as well enough to work “currently”, is that likely to change? 

    I think you need more info. Are you in a union?
