Defaults

Hi all, you’ve been very helpful so far, thanks as always for all advice. We are now 7 months in to this. We have been slowly building an emergency fund, as well as sinking funds. Various default notices have come in. I’m just wanting to check if we are still doing the right thing…

Husband’s Barclaycard has defaulted, debt has been sold to PRA. We got the letter from PRA and immediately went online and set up a £10pm payment. Was this a bit too eager, should be have waited? If so, until when?

My Barclaycard has just defaulted, PRA have bought the debt, and are now phoning daily (ignoring the calls). I’ve not set up the monthly payment yet, and will see how the above question is answered before I do.

Tesco have defaulted, and the debt has been passed to Wescot. Tesco remain the “client” so I’m assuming the debt hasn’t been sold to them. I did try to set up a £5pm payment to them through the link they sent on text message. They said it wasn’t enough and that I should fill in an income and expenditure form - which I didn’t do. They are also phoning daily, and have just sent another very bolshy letter. The link to the payment plan has now expired and they seem to only want me to phone them - which I am not going to do. I could set up a standing order?? Or do I hold my ground and continue to ignore them until they give the debt back to Tesco??

    If your plan is to make payments to PRA, then now is as good a time as any

    If you have bank details to set up a d/d then you can use the same details to set up a standing order

    Look at your latest version of the SOA and see what the total you have realistically to pay to your creditors. (in April someone said it was £300?)  As each default set up a pro rata amount to each or something in that vicinity.  So if pro rata might be £6.43 to one maybe make it £6.  

    But yes, as fatbelly says - set up standing orders.  Don't set up DDs which they can change at will.  with a SO you have the control.  

    And don't ask them to agree to what you will pay.  Tell them what you can afford.  If they want a income and expenditure form you can simply send them a version of the SOA which shows you can only afford £X (£300?).  They've no right to see your bank statements or anything further.

    That £10/month on PRA is fine, shows you’re willing to pay. Ignoring calls from your Barclaycard or Tesco/Wescot is risky, they can escalate to court.

    Court is unlikely if the company gets payments made regularly.  But it might be an idea to pick up the phone, tell them that everything must be in writing and that you won't engage in phone conversations about anything crucial to the account.  If they persist then you can complain about being harassed.

    Wescott only manage the debt, they don`t own it, so can`t take any action whatsoever, with perhaps the exception of asking you to pay, ignore them and they will go through their standard letters/call`s etc, then return the debt to Barclaycard, or as its defaulted, go to their website and make the payment offer again.

    Call`s/emails/texts can all be ignored, anything of importance must come in the post.

    You can write quoting GDPR and ask for contact in writing only, if you want a quieter life.

    Regarding PRA Group, as others have said, no time like the present once its defaulted.

    I ignored wescott ..nothing happened ..they just handed the management of the debt back to the original owner. Then I was passed to moorcroft. I ignored them too. Back again to original owner.  This all took over a year and its now 12 months further down the line and I've heard nothing more. Its given me 24 months of being able to add to my emergency fund.
