CNBC Claim Form from DCB Legal LTD - Help needed
I've received a Claim form for a parking charge from December 2021 for an overstay of free time on a B&M car park, I knew nothing about this fine until now, and would assume the fine was sent to a previous address. How do i go about completing these forms and not paying the amount claimed with court fees of total £299.68.

Do not fill in any forms
Definitely not a fine, private parking companies dont issue fines, magistrates do
Study the 2nd post in the newbies sticky thread in announcements near the top of the forum by coupon mad, then study the first 2 posts in the defence template thread in announcements too
Post a redacted picture of the claim form below after hiding the name and address, and also hide the VRM details on the lower left hand side and also hide the claim reference number and password on the right hand side
Its not a B & M car park, more likely that they just happen to be tenants there, possibly on a retail park
Name the claimant
So more information required before we go any further

So its Smart Parking via DCB Legal, issue date 27th October, so do the AOS stage online on MCOL next week
The alleged breach is pleaded, Overstayed free time
Adapt the defence template, preferably by looking at other recent similar cases on here over the last 8 weeks, especially any which say the same alleged breach
Your final draft should be 11 paragraphs long, not 10, because you should be adding the recent untruth paragraph too1 -

Thank you both, I've found a defence template but this only has 10 paragraphs not 11 as above state i need, and also am i defending part or all ? I also cannot see any other cases similar to mine to get help from0

I've completed the AOS today and i put i intend to defend all of the claim, I hope that's correct as couldn't find info anywhere on this bit.1

My next step is to start defence - (disputing the whole claim) using the template. If I copy the whole 10 paragraphs and past the whole thing do I only need to change paragraph 3 to something like this?
3. The defendant was never made aware of the original parking charge and did not receive a Notice to Keeper. Because of the missed notices the defendant lost the opportunity to challenge the ticket via the normal process, potentially because the notices were sent to an old address.

No detailed evidence of a breach has been provided by the Claimant.
4. Further, regarding the Particulars of Claim paragraph 4, research has proved that this Claimant has never used the POFA 2012 and has never been able to hold registered keepers liable. This is important because the solicitor signatory of the statement of truth on this claim is knowingly or negligently misleading the court by citing that law. Despite tens of thousands of boilerplate claims from DCB Legal causing inflated default CCJs this year – as they have reportedly filed a ‘job lot’ of template bulk claims for this Claimant, all repeating the untruth about the POFA 2012 – Smart Parking has no cause of action against any registered keeper
