CCA questions

Hi all, i recently sent a cca request to a creditor/collection agency. They have sent my postal order back saying it is not required and have also just listed balances of 2 accounts i have with then. 1 account is actually 2 credit cards they have combined as 1 amount, but when i check online it shows 1 amount with 2 sub accounts if that makes sense. Anyhow, they are saying they do not have any details for these accounts and will contact the original creditor who i believe is creation. They have stated that i need to keep paying until they provide this information. Is this correct?

    I wouldn't be paying anything until they produce the cca, as you could be throwing money away if it turns out they can't find it. They obviously want to see money coming in.

    They can't "combine" two accounts. They have to provide documentation for each debt separately, not some mythical beast to which you never signed upEmmel said:

    I'd just stop paying until they provide the CCA, even if it's reconstituted. Pay off other debts or save the sum for "full and finals".

    This is the letter. All my debts are defaulted, all passed to credit agencies and i pay them an amount each month, have done for 2 years, 1 debt is still with the original creditor they send letters periodically but have not as yet sold it on and its been 2.5 years.

    Have only now started the process of CCA requests and this is the first one.

    So shall I stop paying this one in the meantime?

    Yes don't pay these debts ( if there are 2 different debts you need CCAs for both of them )
    If you go down to the woods today you better not go alone.

    Techincally 3 different debts, the 1st one is on its own and the 2nd on listed is a combined amount for 2 debts that they have under the same reference, almost like sub accounts if that makes sense. 2 debts from different lenders but have the 1 reference number from ACI.

    Companies sometimes combine debts if they came from the same original creditor, really for reasons best known to themselves.

    As this combined account never existed previously, you will not have signed a credit agreement for it, therefore they won`t be able to produce something that does not exist.

    This is the folly of debt purchasers combining two debts into one, as legally, the debt cannot be proven.

    Thanks Sourcrates. I was mixed up as i thought they were 2 separate lenders, but it us indeed the 1 lender. Shows as above when i log into my online account. Shows 1 reference number and total balance at the top, then 2 accounts below, each show creditors name, then a number (presume its an account/reference number) and the balance remaining on each (which equals total balance at the top). 

    Unsure if they treat these as seperate accounts or as singles. 
    Anyhow, I have cancelled the payment and shall see what they come back with in the future in regards to CCA.

    I appreciate all the help these boards and you wonderfully knowledgeable people provide

    When you combine two accounts to create a 3rd, that account never existed in the real world, so there will be no paperwork for it, no evidence such as statements of account or transaction details, no nothing, as it did not exist previously.

    When they respond, please let us know what they say to you.
