Hi,
My Amex defaulted. Once it was defaulted it was passed onto Brachers. They have been contacting me, and I made be payment to them, but the next day they have sent a formal letter of claim. I am going to fill it out and show that the payment is what I can afford monthly. But should I call them? Or just send the form back filled out.

I took the card out in 2014. I owe about £5500, in total I owe about £35000 across credit cards annd loans, and am going into a self managed DMP.0

It says ‘formal letter of claim’ it has a reply form. That it says if not returned in 30 days they ‘could take you to court.’ I would have £49.97 to pay towards this debt of my payment. I’ll fill out the forms. I’m just wondering how likely they will pursue it through court.0

It was dated the day after I made a payment by bank transfer. I did wonder whether it was sent before they had allocated the payment to the account. I’ll send the form, and hopefully they will see it isn’t worth going to court.0

Ah, so its an LBA then, (letter before action).
The sole purpose of the LBA is to come to an arrangement with you to avoid the matter going to court.
