Hi,

My Amex defaulted. Once it was defaulted it was passed onto Brachers. They have been contacting me, and I made be payment to them, but the next day they have sent a formal letter of claim. I am going to fill it out and show that the payment is what I can afford monthly. But should I call them? Or just send the form back filled out.

Never call these people, is this your only debt?  How old is the debt? How much is still owing? The answer to these questions will help us.

I took the card out in 2014. I owe about £5500, in total I owe about £35000 across credit cards annd loans, and am going into a self managed DMP.

Is this just a letter threatening further action, a letter before action, or an actual court claim from Northampton bulk centre?

It says ‘formal letter of claim’ it has a reply form. That it says if not returned in 30 days they ‘could take you to court.’ I would have £49.97 to pay towards this debt of my payment. I’ll fill out the forms. I’m just wondering how likely they will pursue it through court.

It's unusual to get one of these if you are already making payment

It was dated the day after I made a payment by bank transfer. I did wonder whether it was sent before they had allocated the payment to the account. I’ll send the form, and hopefully they will see it isn’t worth going to court.

Ah, so its an LBA then, (letter before action).

The sole purpose of the LBA is to come to an arrangement with you to avoid the matter going to court.

Most likely had already been posted before your payment hit the account, I see no reason why they should not agree to your proposal, that is the whole purpose of the LBA in the first place, to avoid backing up the courts any more than they already are.
