Second Hand Good as new?

Hello,
I recently built up a new PC. When booting for the first time I realised that it had already a partition, and an OS installed.
I have since created a new partition and formatted (although I'm sure the old OS can be recovered)
However as I bought the drive as new, (along with motherboard, processor and fan), and it clearly is not, how do I stand legally?

Wherever you bought it from, I'm sure they would replace it if you contacted the company. After all it's not as they described it, so they have effectively miss-sold. Legally you probably are entitled to replacement. The question is really whether you can be bothered with the hassle of packing it up, sending it back, etc. If I were you I would still contact them and let them know whether you intend to return it or not. That way there's a paper trail if the hard drive fails at some point or some other problem arises in the future.0

It's a pity you didn't check to see what exactly was on the drive. Was it just an operating system or did it have other programs on it and someones data.
If it just had the operating system and nothing else, it is possible that the seller also builds and sells PC. They may have put that HD in a PC and installed the operating system on it, with the intention of selling the PC. Then you come along and they find they don't have anymore of that HD in stock, so give you the one in the PC.
Your HD may have been in someone's PC, and used for months, but it may have just been in a short time and only used to install the operating system.0 -
Thanks for the advice, contacted them and explained the problem. On the phone I was told it was an 'internal problem' and that I had indeed received the wrong drive, they then organised a courier to pick it up and replace it with a new one.
I didn't check, the drive, just saw the boot up page and realised it was wrong, I half expected it to be something like a ssd on the mobo booting onto itself so didn't pay much attention until it come to partitioning it0
