Civil Enforcement - Parking Charge - Bellevue, Greenwich High Road

Hi All,

I paid for one hour of my parking in Bellevue carpark in front of ALDI and many other small shops in Greenwich. I decided to extend for additional hour only after 15 minutes of the initial hour expired. So I paid two hours of parking from 15:12 (15:08 as per camera) to 17:29 (17:30 as per camera).

Then received a parking charge notice to my address.

What argument is best to use convince them to cancel the parking charge or to win it in the later stages?

    An unusual contractual breach. "You paid us wrong" would definitely be an uphill struggle in court.

    I would just ignore. It'll likely go to DCB Legal eventually, who will make a court claim and just discontinue.

    Civil Enforcement so do an appeal saying this PCN breaches the '5 minute rule' which is banned conduct this year. The driver paid in full and the Joint Code says you can do so at any point when the vehicle is in the car park.

    Say the same thing at POPLA if you are sure both payments added up to cover the full stay from arrival to driving out past the camera.

    I paid 4 minutes after first entry. Just didn't realise the initial 1 hr period expired hence extended it only after 15 minutes of its expiry. Then I left the carpark 1 minute after the extended parking duration due to queue of other cars leaving.
    The payment covers all of my stay, but the 15 mins between two payments. Is your statement  below still applicable in this case?

    Dear Sir or Madam,

    I write to formally appeal the above Parking Charge Notice issued to the registered keeper of the vehicle referenced above.

    1. Valid Payment and Timeline

    The driver entered the car park at 15:08 and paid for parking via the JustPark app at 15:12, covering parking until 16:12.
    At 16:29, a further payment was made for an additional hour, extending the paid parking period until 17:29.
    The vehicle exited the car park at 17:30, having been delayed due to queuing traffic at the exit.

    At all times, valid payments were made covering the entire parking period.

    2. BPA Code of Practice and the Removal of the “Five-Minute Rule” (February 2025)

    Civil Enforcement Ltd is a member of the British Parking Association (BPA) and therefore must comply with the BPA Code of Practice.
    As of 17 February 2025, the BPA and the IPC jointly implemented a new Single Code of Practice that abolished the so-called “five-minute rule”, which previously allowed operators to issue charges if a driver took more than five minutes to pay after arrival.

    Under the updated Code, operators must allow sufficient time to locate a space, read the terms, and make payment, and drivers cannot be penalised simply for taking longer than five minutes to pay, especially when payment is made electronically through an approved app.

    Furthermore, the 10-minute mandatory grace period after the end of paid time remains in effect for all BPA-member car parks. This allows drivers a reasonable period to leave after their paid session ends.

    3. No Breach of Contract

    The driver paid for parking for the full duration of stay and exited the car park within the permitted grace period.
    Any one-minute difference between paid expiry (17:29) and exit (17:30) is de minimis and entirely attributable to exit queuing, which was beyond the driver’s control.

    No breach of contract has therefore occurred, and the parking charge has been incorrectly issued.

    4. Request for Cancellation

    In light of the above, this Parking Charge Notice must be cancelled immediately.
    Should you refuse this appeal, please provide a POPLA verification code so the matter may be escalated to independent adjudication.

    Please confirm cancellation of this Notice at your earliest opportunity.

    Nope. You failed to cover the whole stay.
