Capquest nightmares!

Hi, I received a demand  from the above, last Friday. It's been giving me anxiety and waking me up!! Today I've read through some of the historic posts on here, re Capquest and I feel slightly better. However I still don't know how to tackle it. I received a letter addressed to my daughter, but at my address. Capquest say that they have bought her HSBC debt. It is for £1900.00 but if I pay £492 now they will scrub it. She left the UK in 2013, and is now a resident of New Zealand. I have spoken to her and she tells me that she paid all her debts before leaving, but it could have been from her student overdraft. She attended university in 2012. I bought the property in 2013 and she has never lived there, but it is possible she used it as a forwarding address, as years ago I used to get her statements from Barclays here.  I haven't had any contact from anyone demanding money on her behalf before. I don't want to ring them (after reading the comments) but I don't mind writing to them to protest payment. Has anyone got any advice on next steps please?

    This is almost certainly statute barred. But if they got a CCJ in 2019, they could try and enforce that until the relevant date this year. 

    So it's important your daughter checks all three credit reference agencies to see if one is registered. The claim would have been sent to her last known address to comply with law. This can be done for free.

    And make sure she didn't make any payments, or written acknowledgement for at least 6 years.

    Agreed, it isn't addressed to you, so don't get involved.

    Thanks v much for you helpful advice. I have asked daughter to perform the checks with the credit reference agencies. I did consider paying it, but I've reconsidered that! I have also printed off a template, using AI to make a written response that doesn't acknowledge the debt, and asks for proof. Fingers crossed for a better sleep tonight!

    Honestly if you want to do anything send the letter back just saying not at this address but don't putt anything that connects you to her.
    If you go down to the woods today you better not go alone.

    Unless it is Scotland it may not quite be statute barred.

    It will be statute barred in all likelihood but overdrafts can be a bit odd in that they can tick along with no payments being made quite legitimately for a long time.

    They are obviously not very confident about this one as they are opening with a 25% settlement. It's all highly speculative. Don't waste too much time on it
