NCP, member of BPA association parking fine for being in car park for 12 minutes (i did not park)...

I’ve had a ‘parking charge to keeper’ notice
It is addressed to my husband, he’s passed it to me to deal with as I was the driver.

I want to a car park and parked for as shown 12 minutes (13:45 - 13:57), in that time I  unloaded 3 kids, went to machine, and could not make it work (a couple actually came by to help) they couldn’t get it to work either (this took several minutes of attempting and failing to get a ticket). I tried to download the app (NCP) but it wouldn’t download - that took several minutes to establish.

I then had to get back to car and get 3 kids back in before leaving to look for parking elsewhere.

I’ve looked at the relevant thread for Newbies and I’m a bit confused.

Wondering can I appeal and do I name the driver (as me, as was my original intention?) however i saw in 'Newbies' thread not to do that...

So do i write a polite letter of appeal? 

Im a bit concerned as it says to pay by 05/10/25 and i only received the letter on 02/10/25, despite date issued of 07/09/25 and date of sending of 22/10/25.  These companies know there are country wide delays with post and yet they still give ridiculous deadlines.

    This needs to me proved to the parking forum as this isn't about consumer rights but parking contracts.

    First point to note is do not contact them at all until you have read the stickies on the parking forum and have checked the dates of your notice as those dates look likely to prevent them from relying on POFA (you'll need to read the stickies for that).

    In the meantime I'm going to ask for this thread to be moved.

    You need to be careful with what you interpret and write, the sending date cannot be the "22/10/25" can it?
    I am sure you mean it was sent on the 22/09/25 in which case what ever date you received it, it cannot be POFA compliant, 7/09 - 22/09 = 15 days it could not have reached the keeper on time.
    So they cannot hold the keeper liable, as long as you do not let on who the driver was they are stuffed. 
    But any correspondence has to come from the keeper, you need to study the newbies thread, and kick these greedy scammers in to the long grass.

    If you contact the store you were trying to visit to explain the situation they may manage to get the invoice cancelled.  Otherwise you might appeal which will likely fail but I think may be worth a try.  Others might say don't bother and wait it out.

    Oh and where was this? England or Wales?  Or Scotland where the rules are different I think.

    Not naming the driver is a good idea in situations where the NTK isn't compliant. I'm pretty sure NCP ones are though, assuming it arrived within 14 days of the accusation.

    To stop your husband being a numpty and secretly paying it would probably be easier just to transfer liability. Plus they really have no case on this one so I'd go in fighting.

    There should be a facility for transfer on their website. Then they should post you a Notice to Driver.

    Then you will be appealing (you can do it online) with 

    "The driver entered the car park and went to the payment machine with their three children. The machine was faulty and would not accept payment. An attempt was made to download the app but there was not enough signal. The driver and family then returned to the car and left the car park immediately - exactly as advised by yourselves should payment not be possible.

    As you know, a valid contract requires offer, acceptance and consideration in order to be formulated. No contract was formed as no payment was made and no hire of the parking space took place as the vehicle left immediately ie. there was no consideration (an exchange of something of value), and the alleged contract was never formed. Therefore no contract ever existed in order to be breached."

    If you appeal (as driver) you are blowing the slam dunk win HE probably has!
