ACI and Perch group letters and texts

I have a debt with MBNA for a credit card I defaulted on from approx 20 years ago that I am being chased for by the above company, ACI and Perch group. I had a CCJ against me, that I didn’t even know about at the time which I assume was due to a house move? I also have not been paying anything towards that. I have heard nothing since until the letters started coming from ACI about 4 months ago. They have all ended up in the recycling and I have not responded to them. I have also had phone calls that I have not answered and have blocked the numbers, but now I am receiving text messages from Perch saying they will be sending an agent to visit my home.

What do I do?!! I cannot and do not want to pay anything, especially from something over 20 years ago! I do not want to speak to them but if they do come knocking I need to know what to say! Any help gratefully accepted, thank you ☺️

What do I say? You say not today thank you and shut the door, they are only door knockers not bailiffs.

What date was the CCJ obtained? If they haven't done anything about it for 6 years they are basically snookered.
If you go down to the woods today you better not go alone.

When was the CCJ issued? Is it still on your credit record?

This could be unenforceable but that date is vital.

Well that’s what I thought but what if they persist? I have a whole spiel of “I don’t know what you’re talking about. How did you get my number and address? That is a breach of gdpr” and have told my partner to say the same! The CCJ is from at least 18years ago but I don’t know the exact date as the only time I was ever told about it was from my bank when I wanted to upgrade my account!! I have not got Experian or other credit checking site.

You can get reports from all 3 CRAs for free.

If the CCJ is 18 years old, and they didn't enforce it with 6 years of issue, they can't do anything now. Do you own a house? Just check the Land Registry in case they got an interim charging order? £7.

I have just got a credit report from Experian and my credit score is 999!! Nothing on there about any CCJ or other debts 👍🏼 so I will go with the narrative if they do turn up of if I have no idea what you are talking about and ask them to leave our property!!

CCJ`s are subject to sec 24 of the limitation act, basically after 6 years they come unenforceable.

A judgement from that long ago is of no consequence now, although the creditor would have you think otherwise.

You can just ignore them, but if they become persistent, send a letter informing them of the age of the judgement, and that expired judgements are unenforceable after 6 years, and you will not be paying this debt, do not bother me again etc etc, don`t go off on a tangent, stick to the facts.

You can also say you have no recollection of ever being sent court papers, and can they provide evidence of the alleged CCJ.

As advised previously your credit score is a fiction. It's only relevant the other side of the Atlantic.

And there are three CRAs. Check Transunion and Equifax as well.

Most unlikely to be anything there, but good practice.
