  • I largely agree with SC, but I still think based on all you have posted bankruptcy would still be the best option.
  • Do not admit liability, first of all have them send you the following: 
    All these companies are buying Debs.
    if the loan was a Business Loan 💵 it doesn’t affect your Personal status.
    Always respond utilising the business Name. 
    IMPORTANT DO NOT AGREE TO ANYTHING UNTIL YOU GET TAKEN TO COURT AND YOU CAN CHALLENGE IT

    To comply with the company’s right to obtain evidence under general principles of contract law and the Data Protection Act 2018 (where applicable), please provide the following:

    1.

    A complete and legible copy of the original credit agreement allegedly entered into by the company.

    2.

    All assignment documentation, including the Deed of Assignment and any Notice of Assignment relied upon to establish Azzurro Associates’ title to the debt.

    3.

    Copies of all statutory or contractual notices claimed to have been served on the company.

    4.

    Confirmation of the authorised representative or director details that Azzurro Associates holds on file, so that correspondence can proceed with the correct company officer.

    5.

    Confirmation of any data being processed or shared relating to this matter, including disclosures to credit reference agencies, in accordance with UK GDPR Article 15 rights.

     

    These are fundamental evidential requirements under contract and data law and are not dependent on the regulated or unregulated nature of the credit agreement.
