Hi Thanks everyone. I have managed to put together an official letter of complaint this morning using a template from the debt helpline. I've sited their lack of contact is unacceptable as they could quite easily have sent me a letter or called in all that time but clearly they haven't. I've gone straight in and asked they write it off due to it being their mistake and I had already had a credit from my last statement which was for the repairs to my house that needed doing. I will be honest 3 years ago I was going to raise a complaint anyway due to issues around my case being passed around and when I moved in the boiler wasn't working but the contact stated a working boiler. but they were less than helpful at the time. Also stating the fact I do not have the funds to pay back and can send a copy of my budget which will show this but I'm holding that information back for now and see what they say initially. I'm not expecting them to roll over and give in but was told to start from write off and go from there.
Once you have completed, the conveyancing contract sort of ends. What you paid for does not include disputes after completion. No matter who the conveyancer was they would not have got involved with that.

I assume if they owed you a grand and asked you 3 years down the line if you wanted the money back (despite it being your mistake and theirs), you would want it back... Im going to bow out at this point because I have been on receiving end of people who try to get out of paying what is owed and as a small business its not a nice place to be in.

Be prepared for them to put a charge on your house then.

There are no excuses, you owe the money and they will certainly not write it off.

They won’t put a charge on your house unilaterally and certainly not while they are dealing with a complaint.

I'm not sure there is much value in a complaint based only on their lack of diligence in chasing the debt as they are still well inside any limitations on that...
You are right though, a charge will not just magically appear at this point, but it is ultimately a possibility...

I have emailed twice now and left 2 messages but no response yet. I'm not saying i won't pay it as such im saying I can't pay it thats the problem. I have no savings. Nothing left on credit and im overdrawn until I get paid. I cannot find £1030 from nowhere. If i have to find a way to pay then i will. Im going down the routes that were advised to be by the citizens advice and national debt helpline. I also don't want to say i'll pay an amount and then when im made redundant if i haven't found work I'm unable to pay that along with other bills as thats why I was already in contact with the debt advice service before I even got this email.
Converted comper to MSE. Thank you for all your answers!
