  • Has he been taking the money from her but not paying into her pension? Or just not deducting pension contributions. Both are wrong but the first is theft.

    If he is flouting the law in his treatment of staff then he might also be flouting the law in the treatment of vulnerable clients in his establishments.
    He needs to be reported to all relevant agencies for investigation.

    Report the company to the Pensions Ombudsman, hmrc and employment tribunal.

    Thanks for replies so far. My wife has been in touch with a colleague that still works there and she has looked at her pension and he has not paid hers either so seems more than just my wife. Currently finding out if has been deducted from pay. Will update when I have more. Certainly will be reporting him to HMRC, Pension regulator and CQC as well as people like him should not be running a care company.

    Update:
    Been reported to HMRC and they were very interested in his message about not caring about the law. They are looking into it. Said it would take a while but they will be following it up.
    Reported to Pension provider who have said they will report it to the relevant people, and they were already aware of the company in this regard of non payment of contributions. The contributions were deducted form wages.
    The lady that left that was not paid the wages due had her case heard and he has been ordered to pay her +£4K but the date has passed and he didn't pay.

    That is all great and reporting it was the correct thing to do. Sadly however it won't directly get you your money.

    If the business remains trading then the lady awarded £4K should be able to take enforcement action for bailiffs or High Court Enforcement Officers to extract payment. Sadly even that has risks as she will need to pay some fees up front which she will only get back if they are successful.
