DCB Legal - Claim Form - UKPC 2-bay parking at Beckton, E6

Hello all. This is my first time using this website, and with a little bit of experience from FTLA.UK, I implore your guys' help in order to give myself the best possible chance at beating this claim from UKPC/DCBL. The reason why I have posted so late is because I was on holiday, and I had erroneously calculated the amount of time I had from the issue date. I thought I had 33 days from the date of service, and not the issue date... So apologies for that completely avoidable newbie mistake. Issue date is 05/08/2025 so I have presumably until the end of this coming Sunday.

Parking Charge Notice Number (as on claim form): 711200176568UKPC

My relation to the registered keeper is a close family member, who is currently dealing with this on behalf of him as the RK is suffering from stress.

Just fyi, I did say the location was exactly the same... I don't know what I was thinking but it wasn't although it was nearby. Beckton Triangle Retail Park, Claps Gate Lane, E6.

Essentially, back in February, the driver (was NOT registered keeper) was visiting Aldi to buy a few items. This was at 6:15pm, and the car park just opposite Aldi was scarce and almost empty bar a few cars. The driver parked in the middle of 2 bays, closest to the kerb on the right hand side (pictures can be provided). The driver parked it away as far as possible from the main entrance, in the corner.

The reasons given by the driver were that the car was recently hit and scratched up (again, pictures of this can be provided) when they had parked in their work car park. They, being young and inexperienced, assumed that the same would be likely to happen had they parked correctly within the bay. The signs were too small to read from a distance, and the driver was only there for 10 minutes meaning that any loss that could've been caused to the landowner/PPC would've been extremely negligible given that the car park that day was barely populated

I did not receive any UKPC Notice to Keeper, nor did I have any notification of this Parking Charge Notice due to postal issues in my area and how it was taking weeks to deliver. There was no windscreen-attached parking charge notice which makes it even worse. The first letter I received r.e this was on 31/03/2025 from DCBL (the useless DRA). I had no way of appealing this charge in the get go, and I don't think I would've had any success in that had I had the chance.

    Is that because your V5C still has your old address on it? Don't assume... this is the usual reason.

    Who is defending this please?

    Whose name is on the claim form, yours or the registered keeper?

  • Nope, I'm sure V5C is not the reason. Have not moved I'm 98% sure that it was due to postal issues in my area where me and many neighbours were not getting all post and it was coming up to 3 weeks late.

    RK's name on claim form. Is there anyway to nominate myself without revealing driver identity (no legal obligation to do so). Also, do UKPC NtK's have flaws according to POFA Schedule 4? Is it arguable that way?

    Name on the form has to defend, but doesn't have to name driver. 

    But becomes tricky because they can't submit an exhaustive witness statement - unless they were there with the driver at the time.

    If the driver wants to submit their own witness statement (recommended), they will have to name themselves in the WS. But no risk in that.

    But the person who's name is on the form does not have to name the driver in their defence. 

    If there are any minor flaws in the NtK it's an uphill battle to persuade a judge it invalidates keeper liability.

    You can't defend this. You can do the written work on it, but all must be in the RK's name. 

    If it gets to a hearing (and there's every likelihood that it will be discontinued before that), you could represent the RK as their Lay Representative - look it up on Google, but while you're there check out 'McKenzie Friend'. Both assist the Defendant, but in different ways, which you'll need to understand should the judge ask exactly how you will assist the defendant. In whatever role, the defendant must attend the hearing.
