Hi got 2 restrictions registered against me and the hubby from 2009 . We are selling and sale is due to complete in 2 weeks. We have 2 so called final charge orders with mortimer clark/reston solicitor and they have said these have to be paid once the house is sold. My Solicitor has already contacted the companies to advise the house is due to be sold and they have emailed back with the amount they are wanting 6k. After doing a bit of reseach it says restrictions dont have to be paid. Ive spoke to my solicitor and she said she will contact buyers solicitior to advise she has issued the certificates as listed in the restrictions on the land registory. But she doesnt think they will accept this and the full amounts need to be paid from the equity. The hosue is joinly owed but the debt is seprate. Can these companys lie and say full charge order but its only restrictions? Due to complete in 2 weeks and need urgent help. Thanks

What do you want to happen to the debt associated with the restrictions if not paid - do you want them transferred to your new property?0

Have you asked the land registry rep?

so you'd have to have the restriction transferred to the new property - you'd need to get a solicitor to do that ( and pay for it ), and you also need to get the creditors approval as well ( and probably pay their solicitors fees as well )Shine25 said:Maybe pay monthly0
