Default in wrong name

Hi All, just a quick question in the hope someone can help. I've defaulted last year with two Santander credit cards with £5k balances each. The debts have been sold on to ARC Europe who are currently pursuing the debt. However, they are chasing for debt which is in the incorrect surname. It's very similar to my surname but not correct. I checked past correspondence from Santander and also my old Santander credit cards which are also in the wrong name. As a similar example, the name is McGaven instead of McGovern. With the debt being chased in the wrong name, can this still be persued? Should I still pay it? Thanks

    I would suggest this is a good case for getting a copy of the credit agreement from Santander.  Make them prove they know who they are chasing.

    Hi Brie, thanks for your response on this. So if I get the credit agreements for both cards and they are in the wrong name, how would I proceed with this?

    You might then want to argue that you are not the debtor, how far you go with this is up to you.
