Cabot Financial

I need advice for a member of my family please. They received a letter saying Cabot Financial had taken them to court, and if debt not paid by 22/8/25 they will send the bailiffs. My family member rung the court this morning , she explained that she had not received any letters etc, she is unwell as she has cancer. Anyway the court person said she cannot speak to cabot, only through the court office. It is for a 10 yr old debt on a Tesco Credit card. She has offered to pay through a payment plan, but court person said Cabot aggressive company. Any advice will be grateful.

    As it's a credit card, if Cabot want to use bailiffs they will have to use the court bailiff who is a salaried employee of the court and so won't cause trouble.

    Cabot know this so it might be a bluff.

    So I assume that the court confirmed that this was genuine and explained where the claim was sent

    It sounds like your family member knows that this is her debt and just wants to pay by instalments. She can do this informally by contacting Cabot and arranging something or formally by applying to court vary the order.

    If it's still within 14 days of the judgement date she can ask for a  redetermination, as this was decided without a hearing. This is free

    Otherwise there is a potential cost to the formal route

    Hi, OK, more information is need here, Cabot do not just send the bailiffs, we need to know exactly what the letter said.

    If she has has not received court papers, as they were possibly sent to an old or incorrect address, then received a judgement in default for a debt that would have been statute barred, she can ask for the judgement to be set aside.

    There is a cost of £300 for this though, although there will be remission on the fee if she is on a low income or on benefits.

    If the debt was not statute barred, of course a payment plan is possible, as is her right, she would need to apply to the court for an instalment order, but first we need to know what the letter said.
