I dont want to kick you whilst your down. But you could have had control over the situation. You obtain legal advice and you get a court order to allow you to sell the house without his signature.
You then move on.
What did you want TSB to do? They cant offer you a new deal because if they do it for you, they have to do it for everyone - they have a contract with you and your ex. If they did gave you a cheaper deal, that is going against the contract they hold with your ex. For all they know, he is refusing to sign a new deal to force your hand to sell the property so he can have a clean break.
But going over ifs and buts doesnt help you.
If you cant get access to your ex, the next best thing you can do (in my opinion) is to find out how to get a court order to sell the house without your ex's agreement. Find a conveyancer who will do it. Speak to TSB and keep them in the loop. Selling the house on your own terms rather than repossession is going to result in lower legal costs and probably a higher sale price. Lets also be honest in that as hard as it might be, with 2 young kids do you really want to be sitting there wondering when the bailiffs are going to knock on the door?
What has happened has happened. What happens next you have some control over and whilst you might not be happy with TSB, liaising with them might be the best route forward and buy you some extra time. On a side note, it might also be worth speaking to them to see if you could port over a smaller mortgage based on something you can afford... chances are they will say no, but no harm in asking.
