ParkingEye claim form using DCB Legal - fine for waiting at a car park

Hi all,

Just been informed by my dad that he's gotten a claim letter for waiting in a car park at Tenpin Bowling. I've filed the AoS already, but now to deal with a defence. 

To no one's enjoyment, my dad has none of the letters he was originally sent and I only know he had pulled up in a safe place to check his phone and send a few texts to his customers. He didn't leave the vehicle or get a ticket in the windscreen so it must be an ANPR camera at entrance. These are the particulars of claims attached below.

Apart from the usual template defence, any pointers on additional relevant points I could add? I tried searching for waiting in car park in the search bar but honestly I dont know if I'm losing my competence or there's nothing similar that is recent at all.

    give Claim form issue date, parking company, solicitors and car park site

    Car parks managed by private firms are best avoided they are definitely not safe places to pull into to check your phone.

    I hope that his government gateway is was used to complete the AOS online   ?  Not yours   !

    Everything must be done in his name if he is the Defendant,  but you can assist him

    Car parks managed by private firms are best avoided they are definitely not safe places to pull into to check your phone. 
    Issue date is 30 June 2025, with the claimant being Parkingeye Ltd and the solicitors are DCB Legal Ltd.

    The site is Tenpin Bowling at Milton Keynes.

    A private car park is definitely not a good place to pull over for sure, the issue must've been in Milton Keynes all these car parks in the area are council owned car parks where people usually do pull in and wait - I think my dad missed whatever sign saying it's a private one! How annoying!!🤦🏻‍♂️

    Which car park, as they're all council nearby on Streetview. Their signage has to be very clear in such a situation. And we know that the clearer the signage the less tickets they get to issue.

    This is the exact location on Google Maps



    I'll have to pass by and see exactly how clear the signage is, but likelihood is there's barely any, it looks exactly like the council car parks... Sigh...

    So, I dont want to drop myself into it so I'll put my draft para 6 here to see if it's good to send through or if it needs major tweaking.

    6) The driver was pulled up on the public section of road to answer a phone call, without entering the marked private parking bays available outside Tenpin Bowling. The Defendant vehemently denies that they formed any contract with the claimant.

    Woefully insufficient signage and demarcation. You can't nestle a private car park in the centre of a massive council one and expect people to know. There's a sign on the right, but all you can actually see is a massive P for parking sign. And it looks like it's for the car park enclosure behind, so they've added an afterthought arrow.

    Why is 'PRIVATE CAR PARK' not marked on the road? Why aren't there two signposts either side of the actual road?

    Did this happen at night? Zero chance of even seeing that if so.
