Options
After sending off the forms, received notice from Disabilities Directorate, that if anyone passes away while receiving Disability Living Allowance, they get rid of any records, our daughter while claiming DLA passed away in 2015. So we cannot get the records we want to help us.. where do we go from here.. Thanks

    It's intersectional.
    The subject refers to HRP, which is State Pension related. There's a link from that to Family Allowance / Child Benefit.
    It's not entirely clear to me where DLA comes into it, though?
    OP really needs to share more information regarding the circumstances.

    Eligibility

    You may still be able to apply for Home Responsibilities Protection (HRP), for full tax years (6 April to 5 April) between 1978 and 2010, if any of the following were true:

    • you were claiming Child Benefit for a child under 16
    • you were caring for a child with your partner who claimed Child Benefit instead of you
    • you were getting Income Support because you were caring for someone who was sick or disabled
    • you were caring for a sick or disabled person who was claiming certain benefits

    Quite a few eligibility criteria there, not just child benefit.

    The Op is claiming  Home Respnsibilty under 

    If you were caring for a sick or disabled person

    You can only claim HRP for the years you spent caring for someone with a long-term illness or disability between 6 April 1978 and 5 April 2002.

    You must have spent at least 35 hours a week caring for them and they must have been getting one of the following benefits:

    The benefit must have been paid for 48 weeks of each tax year on or after 6 April 1988 or every week of each tax year before 6 April 1988.


    but needs proof that daughter wasgetting DLA

    On the HRP claim form you have to fill in the date you started receiving Child Benefit and the date it stopped. Also the Reference number. As we are talking about 1982-1984 I do not have this info. I rang them and, while very willing to help, the gentleman I spoke to said " you have thrown me a massive curveball". The only way they can get this info is to apply to the archives, which will take 2 months. So...do I guess the dates?

    Hi there, I have applied for the above on behalf of my wife, who spent years looking after her disabled daughter, who because  of her disability got Disability Living Allowance.  Her daughter died in 2015, and the Disability Benefits Directorate have no records of her daughter because they destroy them once a person dies. They will not continue with the claim until they get evidence of this. How do I go about finding any records to prove our  claim.

    Which ever its benefits or not, all I'm asking is there anyway to get proof that my daughter received DLA. I'm sure that's not to much to ask... in the end this is going to help my wife, who I'm sure missed out in those early years, looking after her daughter...

    Maybe see if you or her bank can find any of her bank statements. If they record DLA payments into the accounts then there's the proof you need. Otherwise look through any other correspondence you have of hers for anything mentioning it.

    If your wife is below state pension age  she can get a pension forecast which will show if she has missing years.
