    Thank you for your thoughts on this, and I see where you are coming from. However the deceased and her partner had agreed before her death that they would not sue the NHS (against the wishes of her children as it happens). Her partner has been left very bereft by the loss and is not well himself, so I think any addition to his burden would be too much for him to deal with anyway. I was happy to pursue the TPA route on his behalf, thinking there might be some scope for discretion, but it is clear from the advice that I am picking up on this extremely helpful forum, that we have reached the end of the line in terms of what is manageable and realistic. Thank you all anyway, I really appreciate your responses
