Currently in a court process with UK Debt company

Options
I have recently found out I had a CCJ issued in 2019, however I know nothing about it and have moved addresses.
I have applied to court where the CCJ got cancelled and I have filed a defence asking for assigned deed , original signed information , transactions etc Also that I could also request a SAR .

Is the time limit up as the CCJ been cancelled , and I have put in a defence ?
Also they have now emailed me since court asking for my date of birth but unsure why they need this seeing as though I have provided them with my address and court reference number ?

Any advice would greatly appreciate it

This CCJ would have become unenforceable sometime in 2025 and fallen off your credit record. Exactly when was it issued?

Your post is quite contradictory, so I'm unsure at what stage this is at?

Also how have you filed a defence?

I would have let sleeping dogs lie, it would have dropped off your credit file this year, and also judgements become unenforceable after 6 years, it appears no enforcement action has been taken, so I would not have bothered at this late stage.

The CCJ was issued December 2019 I applied to the court and got my CCJ set aside in June this year and I have filed a defence N9B form stating explaining to the court that I have had no documents and was unaware of the debt.  I have asked the debt company to prove my debt asking for statements etc.  The CCJ was issued with another debtor and that went out of business and a new debt company says they have brought my debt and are aware there is a CCJ .
Any advice regarding this I would appreciate it … do I need to fill anything else other than the n9b form … do you think it’s likely it the new debtors will still chase for payment ?

You are the debtor, they are the creditor, basically as I hinted at before, if you had done nothing, the judgement would have become unenforceable in December this year, as it is, it was set aside, and returned to the pre-judgement stage, is that about the gist of it?

So where is this now, what stage, are you planning to defend it, what is your defence?

If you don`t have one you have only made this worse rather than better.

The CCJ got set aside and I have filed a defence stating I know nothing about this debt . I have provided 8 years of address and explained I was fully on the council tax so could have been traceable .
I have asked the new debtor as this company apparently has brought the old debt company out, as the CCJ was with another debt company
prove the debt .. statements , transactions , ownership etc .

The debt is longer than 6 years so can this even be still chased as it’s apparently a credit card debt. I didn’t have one during those times .

    Thank you

Set aside just rolls the claim back to the initial stage. Their particulars of claim stay the same and the court considers your defence against these. If the court decides that you owe the money then a fresh judgement is issued

If you pay this off within one month then it does not appear on your credit file. Otherwise it will stay until 2031 and be enforceable.

At this stage it is better to talk about defendant(you) and claimant

As things stand then the court will look at what you have said in your N9B defence form.

Its common practice for companies to sell debts with CCJ`s attached, the new owner (the claimant) will know nothing of events prior to them purchasing the debt, which is why it would have been a better bet to wait until December, when the initial judgement would have become unenforceable.

However, we are where we are, I`m assuming your defence is "this is not my debt" so you will have to await the decision of the court now, if you have done your due diligence they should find in your favour.
