Update: I have just received a letter from the Civil National Business Centre stating:
"This claim has been transferred to the County Court at XXX for allocation. On receipt, the file will be referred to a procedural judge who will allocate the claim to track and give case management directions. Details of the judge's decision will be sent to you in a notice of allocation."
I have now blocked DCBL's number in my phone as they call several times a week. My hope is while the case has been transferred, it will be dropped before it goes to court.1 -
When you receive your Notice of Allocation, study it carefully and note date for submission of witness statement (and evidence) or sometimes it justs states "14 days before hearing date".4

Hopefully (and very likely) you will be able to add your discontinuation letter to the DCBL Discontinuation thread that is currently 152 pages long and I think 748 strong currently.......

Update: I received a letter with a court date. My witness statements has to be received by 5 February. I have been looking through the forum for any guidance on how to write the witness statement or, better still, templates, but haven't found any. Could anyone point me to it if one is available?
DCB Legal are still calling me regularly from ever changing phone numbers as I block every number they call me from. In any other circumstance, this would be considered harassment.
I hope they will drop the case before it goes to court. How they get away with using the court in such blatant way to pressure people in paying up is beyond me though. Surely there must be something that can be done to stop such conduct? Just a rant. Any help on the witness statement would be much appreciated. Thank you so much!0 -

Believe me, they've been shown DCBLegal's MO and the 750+ discontinuances but I guess they are probably content to think that anything related to court & law firms is the remit of the SRA alone. I'm not so sure. I am trying.
Anyway as this is ParkingEye, if this is a single PCN claim it will be discontinued before the deadline for them to pay the hearing fee.
However, re the WS you are drafting just in case: just copy a recent one and adapt the start & any facts that make no sense for you. My notes of good examples include this:That's a link to their profile and there you will find their thread(s).
That one includes Mazur v Speechlys (which you should know that you obviously need too if you've been keeping up with threads here - it's new case law from September) and it was a well structured WS with sub headings in a DCB Legal case.

My worry is that I followed advice from elsewhere before coming across this forum (I think my defence has been slightly different in the letters I have been sending) and I think the witness statement now needs to be in line with what I wrote already? I will have a look through the link you provided, thank you!
Their payment of court fees is due a month in advance, the WS in a week and a half, so I won't get around writing it, I don't think. How funny would it be if everyone counter sued them, charging them for the time we spend on letters etc. If enough people win that, they'd soon stop those tactics.2 -

Yes, I am aware, hence why I asked for guidance on the WS so I can get that fired off before the deadline. I am currently reading through multiple threads. I wish I had found this forum when I first got the ticket.
