Hello all, hope I could get advice with this debt collections.
i am still waiting for the letter/ confirmation that the debt has been defaulted. Seems like this specific debt still hasn’t been defaulted.

They have since sent me a letter with these lines and I’m feeling pressured now and somewhat threatened which I know is part of their tactics.

We are considering taking legal action

It's important you get in touch with us to let us know how you will be paying your outstanding account(s). As you have not contacted us or set up a payment plan, we are considering taking legal action to recover what you owe.

This would mean:

  • We will instruct solicitors to take legal action on one, or more, of the accounts listed above.
  • A claim form would be issued by the Court demanding payment of the outstanding balance.
  • Additional fees including solicitor's costs and interest would be added to what you owe, therefore increasing your outstanding balance.
  • If a County Court Judgment (CCJ) is granted, we may apply for a Charging Order on your house, which would prevent you from selling your property until you have paid, or apply for an attachment order on your wages.
I have asked via email for a copy of the default letter,  they only sent a copy of the statement of account.
And further emails and letters about legal action.

this debt is a credit card debt with Amazon. Collector is Lowell

Lowell are not a debt collector, they are a debt purchasing company, so they own the debt they are chasing, which also means its likely already defaulted.

Have you checked your credit file to see??

Lowell are quite litigious if ignored, so you need to keep that in mind.

A debt collector can`t take legal action as the debts they chase are just equitably assigned to them, when a company buys a debt, its legally assigned, and they become the creditor, and can take legal action to recover it.
