okay, here's a draft order, and I can try to fit it into the N244 form.

IN THE COUNTY COURT AT: National Civil Business Centre

NATIONAL CAR PARKS LIMITED (Claimant)

And

MR AAAAA BBBBBBBB (Defendant)

IT IS ORDERED THAT:

1. The default judgment dated 22 January 2026 (CLAIM No: AAAABBBB) be set aside.

2. The claim struck out due the missing payment being the fault of the claimant, not the defendant, and that the claim form does not meet the necessary standards as laid out in the Civil Procedure Rules.

3. The Claimant do pay the Defendants costs of this application of £313 on an indemnity basis.

If this is play then I'll put this in a seperate word doc or pdf.

Then I guess that I email it to CCBCAQ@justice.gov.uk (I think) and copy in moorside and some address at NCP? and then I phone the CNBC and pay them money over the phone.. is that right?

It's a Word doc for the Draft Order.

It's designed for the judge to use & add dates & their name to. So NOT a PDF.

In the N244 question you can just shorten it:

The default judgment dated 22 Jan 2026 be set aside, the improperly pleaded claim dismissed and the defendant's costs awarded on the indemnity basis.

@1505grandad I must have typo'd somewhere because my notes all say the 22nd Jan, but thanks for making me check 👍🏻 I'd rather get it right.

Question 9 on the N244 form asked who should be servied with this information, is that for me to put NCP and Moorside legal with their postal addresses? or do I just cc them in the email that goes to CCBCAQ@justice.gov.uk? is this address correct as it says CCBC not CNBC?

Anyway, first thing Monday I will put together an email with the revised N244 form, a PDF with chan and akande in, a PDF with the NCP portal webpage in it and a word document with the draft order above. This email will then be sent to CCBCAQ@justice.gov.uk (unless you tell me it's a different email?)

I will also cc in NCP at appeals@ncp.co.uk (the only email address I have for them) or customer.service@ncp.co.uk (gleaned from google) and Moorside legal at help@moorsidelegal.co.uk or litigationteam@moorsidelegal.co.uk (both addresses came from this forum as contacts). any suggestions as to which of these addresses to use is gratefully received.. or do I let the court do that?

Then I will phone the CNBC and somehow make a payment for the court fee, send the email and wait… is that right?

PS. if I get to the end of this with a successful result, I will document all of this for future reference…

Note of caution - don't forget they're in Administration. I don't fancy on you getting your £313 back.

I'd get some specialist advice because your application could also be stopped in its tracks:

Pursuant to paragraph 43 of Schedule B1 to the Insolvency Act 1986, a company in administration is protected by a statutory moratorium in that no legal process (including legal proceedings, execution and distress) may be instituted or continued against the company or its property except with the consent of the administrator or the permission of the court.

It may just be that you will need to seek permission from the court within the text of your Order.

That email address MUST be wrong because they haven't been the CCBC for a couple of years!

The admin centre is the CNBC and their email contact list is easy to Google for.

And you don't copy in anyone. Certainly not NCP who are in administration and did not file the claim.

yeah well, I might not get the money back, but I can ask though…

regarding my application, as I understand it, I am not taking them to court, I am responding to them taking me to court… or am I misunderstanding? either way, as much as I'd like the money back and think it's a reasonable ask, my primary concern is the CCJ

in terms of copying people in, I thought I had to.. happy not to though.. question 9 on the N244 form does ask who should be served with this application.. do I leave it blank? will the court inform NCP about this?

Yes the court will serve a copy to the C's solicitors.

It's a fresh application, so it depends which way you look at it.

I don't know the answers, but just thought it was just worth highlighting the increased risk so you're aware.

I've emailling my N244 form and supporting documentation in now. I will phone up tomorrow and see how they want me to pay the fee and then I wait I guess… Many thanks everyone for your support, I will let you know what I get back.
