That's irrelevant and I've no idea why so many people look at that! It is implied by the driver parking in a 'managed' site. So that phrase isn't objectionable in itself.

I thought that might be the case but I wanted to check.

It is plain that the POC don't say what the term or breach actually was, so simply copy the usual Chan & Akande wording already written and copied on threads, hundreds of times this year alone.

ahh right, I've just got it. it merely says that I was parked in breach of the terms, but not which term was breached… I've got it now. I will add something to that effect.

I've still not heard anything from mr caluscabal so if I don't get anything by end of tmw then I guess I'll be sending it off just with my input.

the letter from moorside on the 27th Jan just says that a CCJ has now been entered against me.. do we think that they'd be 6 weeks late with that info? or do I need to ring CNBC again to confirm?

Well it sounds more like the date of CLAIM could be December, unless you have that?

You can do a free credit check online then immediately cancel any subscription, the credit check will show the date of CCJ.

experian tells me 22nd Jan 2026.. so I guess I'll go with that. This is the only CCJ I have ever had so I hope it would be findable by the pwoers that be…

okay, with all the advice here I'm fairly happy with my witness statement. looking at the N244 form now to make sure I get it right. I tihnk I'm nearly ready to go.

top right box:

The letters from the solicitor were filed without my sight and I never received any notification from the court. I only discovered the judgment when I struggled to get finance.

so I'm a bit unsure of the answers to question 9 and 10 a bit.

Also, there's an indication on the N244 notes document that I need to supply sufficient copies of my application but how many is that?

then.. err.. silly question but how do I actually submit this? is there a webform, or an email address or am I printing it out and physically posting it? how am I paying for this? I have been searching online about it but most of the discussion, esp here is about what to submit, not how to submit.

I think I can email it to CCBCAQ@justice.gov.uk but then I guess I'd need to ring someone to pay the fee? if I am submitting it like that do I need to cc in NCP, or moorside? or both?

and your point 3 is meant to exactly match your draft order. Copy a Draft Order from a recent CCJ thread.

point 3 doesn't have much space on the form for me to put in lots of text.. then again, does the draft order need to be much more than:

IN THE COUNTY COURT AT: National Civil Business Centre

NATIONAL CAR PARKS LIMITED (Claimant)

And

MR AAAAA BBBBBBBB (Defendant)

CLAIM No: X0XX0XX

IT IS ORDERED that:

1. The default judgment dated 22/01/2026 be set aside.

2. Costs to be awarded on indemnity basis.

it feels a bit forward of me to be writing a judges final order in my favour…?

Honestly, it helps the court. Judges love a Draft Order - attached as a separate Word Document - as it makes their life easier (and the Claimant will try to foist one on the court asking for no order as to costs).

You need to add the usual middle bit about the claim being dismissed. See & copy from recent CCJ threads from 2025 or 2026.
