Link Financial - No CCA produced, but a possible issue.

Hi folks,

So I have 2 debts with Link Financial, I have had a repayment agreement in place for some time now. 

I have sent the CCA requests for both accounts, and unsurprisingly got no reply.

Now, from what I understand, I could stop making payments until they produce the CCA's, as the debt is currently unenforcable.

However, they are reporting both debts to all CRA's as active credit card products and are reporting the balances monthly. It looks like they started doing this in the middle of 2024.

Can anybody advise on this, these are both originally Aqua credit cards that I defaulted on during covid times, but these defaults seem to have been removed from my credit profiles.

Should I continue making these payments?

    You should have stopped payments when you submitted the CCA requests.

    Stop now and see what their reaction is.
    If you go down to the woods today you better not go alone.

    Your question has an easy answer: No

    Getting them to mark your file correctly might be more difficult but you can leave that argument for later

    When Link bought your debts, they also assumed responsibility for reporting on them to the CRA`s.

    The Aqua entries will have disappeared to be replaced by the entries from Link.

    This is normal, as long as the default date is the same, if its not, then that needs to be addressed.

    thats the problem, there is no default date as they are reporting both as open credit cards

    In that case you should put this all in a letter to Link, mark it "COMPLAINT" and they then have 8 weeks to deal with the matter.

    If your not happy with their response, you can get the FOS or more likely the ICO involved.
