A year and a bit ago my partner and I had a despute with our landlord. They wouldnot sort out the heating in the house, so I withheld my rent payments untill they sorted it out. Eventually we moved out because the house was to darned cold to live in. Whilst trying to sort things out with them they took us to court. However the first we heard about it was when my partner had an attachment to earnings order sent to her employers.
Now, not only did we have no idea that we had been taken to court, so could not defend ourselves, but it ws me who payed the rent each month, and who carried out all communications with the landlords. It is very unfair for them to have been able to put a ccj in just my partners name (although I imagine that they have gone with the person who has the highest wage). I have tried to get the order set aside, but the landlord appealed and my partner now has fifty pounds a month deducted from her account. I do not understand how they could have appealed when We stated that we did not know we had been taken to court, and that they had taken the wrong person. Also her perefect credit history now has a CCJ on it which will stop us getting a reasonable mortgauge. Any ideas?

Whose name was the tenancy in? I would try and have another go at having the judgment set aside. I have just been involvedin this, from the claimants side, and I was surprised how easy it was to do for no obvious reason.
On what grounds did you ask for the judgment to be set aside? was it because you did not receive the summons and if so for what reason?Loretta0
