Swift have been chasing a welcome finance debt that was taken out in 2007. It was a secure loan
Last payment made was I believe was when welcome went bust 2011
I requested information they held on us, which they still haven’t sent
They are saying last payment was Dec 2014
And now issues court papers for June 26 for repression for a 20k debt
Is it too late to offer payment? Or should we remortgage to clear this off? Can’t afford to lose house for 20k.
The claim form looks printed and not official
Thanks in advance

You can reach agreement on a payment plan, though they may still want a suspended order on those terms
Or pay the whole thing off
Have you got a copy of the original agreement? If not it may be worth asking them to see if they can provide it0 -
No I haven’t should I ask for it?0

Yes. They should have it because that is the basis for their claim.
You could then run it past a specialist solicitor as some Welcome loans were found to be unenforceable in the early 2000s.0
