Quick Check - Gladstones Claim UPDATE 19/7/25 - Default CCJ

Afternoon all, been a while although I'm glad to see my old "intellectually malnourished" quote has caught on in my absence! 

Feel comfortable with the rest of the process off the back of winning a case as a lay rep for someone back in 2023. Had this one through for myself, claim dated 16th April, AOS being handled. 

This is possibly the worst PoC I've seen, given that it has no dates, a claim for interest at 8% for £0.00 per day, amount claimed is £0 etc. All they're after is the court fee.

Anyway, just to check, it's still CEL v Chan, with references to CPR 16.4 etc about the inadequacy, that I need to use in the defence submission. After all, I have absolutely no idea what I'm defending or when it happened.

    Email contestor legal ..they can get this struck out no win no fee(worth doing for this)  tell him in header refered from MSE forum. 
    Include the claim form and put it for the attention of Jackson.

    As above. We've seen a few like this with 'zero' monies claimed.

    Must be a software glitch at Gladstones.

    Yep, they are discontinuing these,  so expect a new claim with correct details

    Just to come back to this, and in the process of reviewing the various posts. As expected, the above was discontinued. 

    What's caught me by surprise is that, today, I've received a judgment in default with a different claim number, dated the 15th July. I have never received an amended claim form, even though this was expected despite reengaging with Gladstones. 

    Reading up on N244's at the moment, but there is a pressing issue for me here; I'm currently right in the middle of a remortgage application where I'm changing banks. 

    I intend to call CCBC first thing Monday morning to find out when the claim was sent, but I'm not sure how long things are currently taking for set asides, as for obvious reasons I need this to avoid showing. My understanding is that if I paid the judgment, it might be closed down and any application for set-aside prevented.

    Ok, definitely gone down the rabbit hole with this tonight. What I'm getting so far is:

    N244 for discretionary set aside - Likely to need to push CCBC for this process due to non-receipt as not the fault of claimant.

    Contacting Gladstones due to not receiving the form, as they should set aside on this basis. Could potentially get agreement. 

    Need really is to do something before the mortgage is due to go through in September, so may have to actually make payment and then try and get things back to square one. 

    I'm still nonethewiser as to what I'm potentially going to be using in the defence, as I don't know the date or location. It may have been on the new form though, and I'll need this from CCBC. 

    I remember saying to my neighbour about a week or so ago about not having had any post for a while, not even junk mail. Instinct is a RM issue, but then the rabbit hole led me to a few others for what I assume will end up being a June date.

    On to CNBC this morning, PoC rec'd. Key extract:

    "THECLAIMANT CLAIMS THE UNPAID PCN FROM THE      DEFENDANT AS THE DRIVER/KEEPER OF THE        VEHICLE. DESPITE DEMANDS BEING MADE, THE     DEFENDANT HAS FAILED TO SETTLE THEIR         OUTSTANDING LIABILITY. THE CLAIMANT CLAIMS   £80 FOR THE PCN, £70.00 CONTRACTUAL COSTS    PURSUANT TO THE CONTRACT AND PCN TERMS AND   CONDITIONS, TOGETHER WITH STATUTORY INTEREST"

    Google Maps data shows on the date in question a bar nearby, and partway through the period it's claimed to park driving 1.5 miles away and being there for a few hours. The destination after the supposed end of parking is a Chinese takeaway which is cash only. and as the Tesco is between the two points, possible stopped there to use the cashpoint on route. Not 100% sure who was driving on this occasion, but Horizon aren't POFA on theirs normally. 

    Also, PCN is £80 according to the claim. Signage on site photo'd 3 days ago in person shows a £70 PCN. I photo'd a damaged sign (slightly bent out of shape), and that same sign, also bent out of shape, is visible in GSV 3 months prior to the date the event took place, so suggests PoC was false statement of truth. Not sure how this would go down with a judge though over £10. 

    Now to work on the set aside.

    Also, to tie this into some of the other cases, issue date is the 11th June, with CNBC claiming service date of the 16th.
