CCA

Hi all,

My Next account defaulted last year as part of my self managed DMP. Next in house collections took over and then another company which I think was Ardent Credit. I asked Ardent to supply CCA, they could not.  Since then I have been contacted by Advantis who say they are working for Next. They produced a CCA which I did not believe to be legible. I received this email last week asking me to contact Next directly to obtain the CCA instead of them supplying me one. I have never heard of this? I am wondering what my reply should be. I have attached the email I received. TIA

    So  the are saying they can't produce the CCA, you can ask Next for the CCA, ignore the collection activity threat. it just means they will contact you again.
    If you go down to the woods today you better not go alone.
  • Yes - they produced one which I believed did not fit the criteria so they came back asking me to contact Next for it. I don't believe they own the debt, I think they are working on behalf of Next. Next don't want to seem to sell this debt and it's relatively small.

    They are definitely working for Next, that's why they referred to Next as "our client". So just ask Next to supply the CCA.
  • I'll be honest, I'm not going to ask Next. I will keep ignoring them, unless they want to offer a full and final settlement. I am waiting for a response from Next regarding irresponsible lending so they may provide the CCA with this.

    Yes, this is the correct approach - why do their job for them?

    I suspect Next may well supply a CCA at some point but use the intervening period to build your F&F pot.

    They won`t supply a copy of your credit agreement unless you ask them under section 77.

    It is the duty of the collection company working for next to pass on your request, you say they provided a copy, but it was illegible, and referred you back to next.

    I assume that`s where they got the copy from in the first place, so why would you expect the outcome to any different a second time around?

    Under sec 77, any copy agreement provided must be legible, if it isn`t, them it is not a compliant copy.
