Link have assumed, or taken the position, that their response should be to throw you off guard, by instead of providing evidence of your liability for the debt, they spring on you the fact it was an overdraft and not a CCA regulated debt under sec 77 CCA.

Just a shirt update to say that it has now been 6 weeks and not had a response to the defence submitted
Having not done this before I was wondering if they don't proceed do I receive something to say so? Is there a maximum time they have or does it just sit there0 -
You could ask the court to strike out the claim but that might just kick start everything.
You don't have a ccj. There's no problem in just leaving it, is there?
You have made things more difficult than expected for them. They probably keep moving it to the bottom of the pile. Eventually they will decide either to plough more funds into this or issue a notice of discontinuance.3 -
