CCA Request

Just want some views on this. Is it silly asking for CCA agreements for 2024 year credit agreements... hoping they cannot get one for legal action enforcement. Cant really find much information on new agreements but found a fair bit for older agreements

    My guess would be that a new CCA would be all electronic so would be quick and easy for them to find and won't actually have your signature on it.  Unlike one from say 2010 where you would have been sent something for an ink signature which they supposedly might have in a filing cabinet somewhere. (and was likely shredded after a couple of years)  

    The only electronic ones I would guess might be something that you can fight against is where there is a material error on them.  Like they have your married name on them but you've never used that name or similar.  

    edited to add - but if you ask then it may be useful as a delaying tactic....

    that is my thinking, the only thing I would add is that they may not have the ability to obtain the agreement from the bank, I know some banks just don't respond sometimes to these requests. I think the best bet of delaying tactics it just to DMP the new ones and allow time to go by without prompting paperwork for a while

    don't forget that if you make payments, even really minor ones like £1 a month, you are acknowledging the debt and that will delay it being statute barred - assuming that is your aim.

    I think SB for my case is for the birds on a number of mine and the mrs... 2024 agreements and we own a home. From experience of talking to others with similar situations court action eventually comes up before it gets to SB. I am taking a 12 year process rather than 6 for SB.

    When I have seen it be sent all the way on top of that it usually ends up with a settlement or defeat in court too... so what is the point really?

    There are no hard and fast rules, generally speaking the chance of finding the cca decreases as time goes on and as the number of times the debt has been sold goes up. There is probably a good chance that they could provide the cca for a 2024 debt, I'd make minimal payments for now and then make a cca request when you have enough money to make a settlement offer.

    Yea that is my thinking Rob, I dont intend to settle tbh.. I am happy to delay to as long as required to then eventually look to CCA them at the appropriate time perhaps
