Is this legal by Bristow & suitor

hi, this is all me to me so not sure if I’m in the right place. Due to illness my other half lost her job and we fell into debt. We have 2 curt order payments with Bristow and suitor which works out to around 35% of my wages. However as one debt is nearly cleared I’ve noticed they’ve stopped taking money off of that debt and are using it all against the bigger debt. Is that legal? I’ve contacted them a few times but keep getting fobbed off. Thanks in advance

    Not actually illegal. If there's nothing else going on, and the arrangement is affordable, I'd leave it as it is.

    You don't say what the debts are. Council Tax?
  • Hi, yes it is council tax, the problem I have is that the arrangement isn’t affordable. We are now falling behind on other bills because of this. I don’t understand how the courts can give them a percentage for each debt but they can pick and choose how much they pay off each. If they had paid it like they should have we would have one debt cleared and now be paying half the amount they are taking from us. Which we would be able to afford.  I call them and they either tell me they can’t access my account or I need to speak to a certain team and then they say they’re transferring me and I’m put on hold forever.

    Is this an attachment to earnings?

    The courts wouldn't normally set an amount for council tax but the deductions from earnings are set by statute
