Hi Everyone,

Hoping someone can help here. My wife was a member of a gym that she explicitly joined for the swimming pool. It was out of order more days than it was working.

My wife went ahead and cancelled, citing the unavailability of the pool as the reason she was was leaving and wrote a letter of complaint.  She didn't pay the remaining balance as a form of protest because they stopped replying. She didn't say she wouldn't pay it but that she disputed.

The Gym stated that she was not telling the truth and that the pool was open... but... it wasn't. We have screenshots of the near daily outages the gym themselves posted on the their webpage.

When confronted with this they went radio silent. Next thing.. Arc Europe pop up and claim the <£70 owing.

How do I play this. I suspect the first step is writing via recorded delivery to Arc Europe telling them the whole debt is in dispute and that the Gym are not willing to reply or entertain communication. That should pause them whilst it is dealt with?

Follow that up with an official complaint to the Gym in question laying out the issues and suggesting they drop the matter? Also copying in their legal dept. For good measure GDPR request and also informing them that we are (truthfully and honestly) classed as vulnerable adults?
