I can't answer your specific question but I'm guessing you are already aware of the fact that Scotland has its own legal system - something that is often not understood by those from the rest of the UK, particularly those who only discover, too late, that in Scotland the drink/drive limits are only just over half of those in RoUK (specifically, they are only 5/8).
But you might like to read this information published by the Scottish Government, and then consult the UK Office of the Public Guardian.
