Looking for some advice from anyone who has had a similar experience. 

In November 2024 I received a court claim pack for £26000 in relation to a property which was repossessed. 

At the time of repossession I was going through a nasty separation following years of domestic abuse. My ex refused to sign the paperwork for the property to be sold and I could no longer afford the repayments, hence the property being repossessed. 

I have an indefinite restraining order against my ex and he was incarcerated at the time. This was in 2011. 

In 2017 I was contacted by the lender pursuing the debt and I wrote to them explaining my situation (my financial position hadn’t improved due to significant unsecured debt which accumulated as part of the abuse). I never got a response. 

Then, out of the blue, just before the 12 year limitation period I get a court pack. I sought legal advice in November and they helped me file an acknowledgement of service and requested an extension. 

I proceeded with a defence and sent this to the court in the timescales. 

I heard nothing back and started to chase. 

They have now said they haven’t received my defence, despite me sending it recorded delivery and being able to prove they have received it! 

I have since submitted the info again and have expressed my worries regarding this. 

The civil court procedures state that the claimant should respond to my defence within 28 days, this has not happened. 

Has anyone else had a similar experience and what was the outcome?
