Yet another Statute Barred question

I've just received a letter from a company representing capquest/HBOS for a debt that can only be from sometime pre2007. I have never contacted them in this time. Am I safe sending a national debtline statute barred tempplate letter to tell them to not contact me again? I don't want to trigger a communication that might set me up for liability.

As long as you are certain the debt has not been paid or acknowledged in writing for any period of 6 years since it defaulted, then yes.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Yeah, I was living in France for a few years around 2009ish and when I got back in 2012ish I started rebuilding my credit, up to excellent now. Don't want to do anything to mess that up. So it's safe to send this letter.sourcrates said:As long as you are certain the debt has not been paid or acknowledged in writing for any period of 6 years since it defaulted, then yes.

If you are unsure which debt this relates too, then send the prove-it letter, let them do the donkey work.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I'm pretty sure I know it's a credit card that got out of hand during a break-up in the early 2000's. Is there any downside to sending a prove-it letter over just sending out a statute barring letter or vice-versa?sourcrates said:

Its the standard response to someone writing to you asking you to pay a debt, any debt.
They are formally required to provide you with details of the debt they are chasing, so if there is any doubt in your mind, take the safe option of sending the prove-it letter first, you can tell them its statute barred at a later date if needed.
If you send the statute barred letter, then find an issue with it, and you have re-started the clock by acknowledging the debt in writing, that`s not a good idea, the prove-it letter is specifically worded so as not to acknowledge anything, so to be safe, send that first.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
