Bankruptcy Feb 2022

Hi, my son went bankrupt in Feb 2022 because he lost his job and was in debt up to his eyeballs, he was living in a rented flat and was behind with all his bills. He eventually moved out of the flat in May 2022 when a court order ordered him out, during this time he did not pay anything including council tax.  Now he has received a bill for over £600 for council tax from Newlyn Debt management. As he went bankrupt in the February 2022 and was in arrears with the council tax, they are saying as he didnt move out until May 2022 he is still liable for the debt? please can someone help ! thank you

    They are correct unfortunately, the current years Council Tax and any arrears from previous years are vested in his bankruptcy.

    However, he went bankrupt in February, the Council tax year ends in March, when the new bill is sent in March, his liability will have resumed, if he had waited until the new bill was issued and then gone bankrupt, then that would have been covered by his bankruptcy.

    As it is, he is liable for April/May`s payment, I suggest he contacts the council and asks them to take the debt back from the bailiffs and sort out some kind of payment plan with them.

    Thank you ! he stayed in the flat waiting for an eviction notice and that didnt come through until May 2022, he was not working or claiming benefits. I will get him to contact the council, he has phoned the debt collection agency and they have put it on hold for 1 month, so hopefully we can sort it out in the meantime.  Thanks again for your help
